Welcome to FORSA — Saudi Arabia’s marketplace for construction tools, equipment, building materials, and related services at forsa.com.sa and through our mobile application.

These Conditions of Use & Sale govern your access to and use of FORSA Services. By using FORSA Services, you agree to these conditions. Please also read our Privacy Policy and Returns & Refunds Policy.

Arabic and English versions are published. If there is any inconsistency, the Arabic text prevails to the extent permitted by Saudi law.

Part A — Conditions of Use

1. Electronic communications

When you use FORSA Services or send emails to us, you communicate with us electronically. You agree that agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by the Saudi E-Commerce Law and other applicable regulations.

2. Recommendations and personalisation

We may recommend products, categories, vendors, or features based on your browsing history, orders, and preferences to improve your experience.

3. Copyright and intellectual property

All content on FORSA Services — including text, graphics, logos, images, software, and data compilations — is owned by FORSA or its licensors and protected by Saudi and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written consent.

4. Trademarks

FORSA names, logos, and trade dress may not be used in connection with any product or service that is not FORSA’s, in any manner likely to cause confusion, or in any manner that disparages FORSA.

5. Licence and access

Subject to your compliance with these conditions, FORSA grants you a limited, non-exclusive, non-transferable licence to access and use FORSA Services for personal, non-commercial shopping purposes. You may not:

  • Resell or commercially exploit FORSA Services or product listings.
  • Use automated tools (bots, scrapers) to extract data without permission.
  • Interfere with the security or operation of the platform.
  • Use FORSA Services for unlawful, fraudulent, or abusive purposes.

6. Your account

You may need an account to use certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate, current information and notify us immediately of unauthorised use at [email protected].

We may suspend or terminate accounts that violate these conditions, applicable law, or our policies.

7. Reviews, comments and user content

You may submit reviews, ratings, questions, and other content provided it is lawful, accurate, and does not infringe third-party rights. You grant FORSA a non-exclusive, royalty-free licence to use, display, and distribute such content in connection with FORSA Services. We may remove content that violates our policies or applicable law.

8. Intellectual property complaints

If you believe content on FORSA infringes your intellectual property rights, contact [email protected] with a detailed notice including proof of ownership and the specific listing or content concerned. We will review and respond in accordance with applicable law.

9. Mobile application

Use of the FORSA mobile app is subject to these conditions and the applicable app store terms (Apple App Store / Google Play). App updates may be required for continued access to certain features.

10. Third-party businesses

Independent vendors and other third parties offer products and services through FORSA. We are not responsible for third-party content, policies, or conduct. You should review vendor information and product details before purchasing.

FORSA’s role as a marketplace

FORSA allows independent vendors to list and sell products on our platform. Unless clearly stated otherwise on a product page, the vendor — not FORSA — is the seller.

  • The contract of sale for third-party products is between you and the vendor.
  • FORSA provides the platform, payment facilitation, and customer support coordination but is not a party to the vendor–buyer contract except where FORSA is explicitly identified as the seller.
  • Vendors are responsible for product descriptions, pricing, availability, fulfilment, warranties (where applicable), and compliance with Saudi product and safety regulations.
  • FORSA may assist with dispute resolution between buyers and vendors but does not guarantee vendor performance beyond any buyer-protection programme we expressly offer.

11. Limitation of liability

FORSA will use reasonable efforts to keep FORSA Services available and error-free, but uninterrupted access cannot be guaranteed. To the fullest extent permitted by Saudi law:

  • FORSA is not liable for indirect, incidental, or consequential losses including lost profits or data.
  • FORSA is not liable for vendor acts, product defects, or delivery delays caused by factors outside our reasonable control.
  • Nothing in these conditions limits liability that cannot be excluded under mandatory consumer protection laws in KSA.

12. Force majeure

FORSA is not responsible for failure or delay due to events beyond reasonable control (including natural disasters, government actions, network failures, or labour disputes).

Part B — Conditions of Sale

13. Contract formation

When you place an order, you make an offer to purchase the listed product(s) on the stated terms. A contract is formed when the seller (vendor or FORSA, as indicated) accepts your order — typically by sending an order confirmation email or dispatching the product. We or the vendor may cancel an order before acceptance (e.g. pricing error, stock unavailability, or suspected fraud).

14. Pricing, VAT and invoices

Prices are shown in Saudi Riyals (SAR) and include Value Added Tax (VAT) at the applicable rate (currently 15%) unless stated otherwise. ZATCA-compliant tax invoices are provided where required. We reserve the right to correct pricing errors and cancel affected orders.

15. Payment

We accept payment methods displayed at checkout (including Mada, credit cards, and other methods supported by our payment partners). Payment is processed through certified third-party gateways. You represent that you are authorised to use the selected payment method.

16. Delivery

Delivery options, costs, and estimated times are shown at checkout and may vary by vendor, product weight, and location within KSA. Risk of loss passes to you upon delivery to the address specified, unless mandatory law provides otherwise.

17. Cancellations

You may cancel an order before it is dispatched by contacting us or the vendor through your account. After dispatch, cancellation may not be possible; see our Returns & Refunds Policy.

18. Returns and refunds

Returns and refunds are governed by our Returns & Refunds Policy and the Saudi Consumer Protection Law and E-Commerce regulations. Statutory rights are not affected by these conditions.

19. Equipment rental

Rental products are subject to additional rental terms shown on the product page and rental inquiry form, including deposit, duration, and return condition requirements.

20. Prohibited products

Products that violate Saudi law, public order, or safety regulations may not be listed or purchased. We may remove listings and cancel orders that breach these rules.

Applicable law and disputes

These conditions are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from or relating to these conditions or FORSA Services shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, KSA, without prejudice to mandatory consumer rights to bring claims in other courts where applicable law allows.

21. Changes to these conditions

We may update these conditions at any time. The version in force when you place an order applies to that order. Material changes will be posted on this page. Continued use after changes constitutes acceptance unless applicable law requires otherwise.

22. Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full force.
